WARRANTY
Automatic
Control Solutions, Inc.
warrantees all equipment conditionally for a period of Two years from date
of purchase. This warranty includes
Two years on parts and one year on labor necessary to correct any defect in material or workmanship to
manufactured equipment by Automatic Control Solutions, Inc.
The customer shall not hold Automatic Control Solutions, Inc. responsible
or liable for any consequences occurring due to the performance of this
equipment or any implied warranty, but only for the operation of this equipment.
Automatic Control Solutions, Inc. makes no guarantees with respect to
merchantability or use of equipment for any purpose other than the express
function for which it was sold. The
method of claim is as follows:
Defective
components shall be identified to Automatic Control Solutions.
Diagnostics will be provided to the end user to determine the nature of
the warranty problem. Automatic
Control Solutions shall determine if parts are to be repaired or replaced and if
a remedial maintenance visit is required. The Seller's sole obligation under
this warranty shall be to repair any item of equipment that is repairable or at
its option, refurbish, overhaul, rebuild, or replace any item of Equipment that
has been promptly reported as defective in material or workmanship by the Buyer
to the Seller and which has been determined by the Seller to have been
defective. If failure to a component is found to be due to customer
negligence, abuse, or improper use of equipment, then the customer will be
responsible for service and travel expense in addition to the cost of any
equipment or materials needed to correct claim. Automatic Control Solutions, Inc.
will honor any warranty of equipment not manufactured by Automatic Control
Solutions, Inc., but supplied as a part of Automatic Control Solutions, Inc.
Systems, for the duration set by the equipment
manufacturer.
Automatic
Control Solutions, Inc. can provide the customer with an extended warranty and
service agreement for repair, replacement, and service of any equipment
manufactured or supplied by Automatic Control Solutions, Inc.

THE ABOVE IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY THE SELLER. THE SELLER MAKES AND THE BUYER RECEIVES NO WARRANTY EXPRESS OR IMPLIED AND THERE ARE EXPRESSLY EXCLUDED ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE SELLER SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR OTHER PECUNIARY LOSS, OR FOR ANY OTHER SIMILAR DAMAGES), EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SELLER SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED BY A DELAY IN THE FURNISHING OF MAINTENANCE SERVICES UNDER THIS AGREEMENT.
